Adoption
Adoption in Malta may only take place with the authority of the COMPETENT COURT granted by decree following a recommendation made by the Adoption Board
In establishing whether an adoption decree should be granted the court will hear any person entrusted with the care and custody of the child to be adopted; the natural parents if any; and if it deems fit, the Court may also appoint an advocate or a social worker to protect the best interest of the child and secure the child's representation.

There are various criteria which must be met for an adoption application to be successful amongst which:
- Married couples wishing to adopt must be married for at least 3 years;
- Cohabitating couples cannot jointly adopt and the application must be made by a single person granting no rights to cohabitation partner.
- One of the applicants must be at least 28 years of age.
- The maximum discrepancy in age between any adoptive parent or single person and the child to be adopted is that of 45 years.
